Privacy Policy
The privacy and security of your personal information is important to Kate Morgan Pty Ltd. (ABN 82 120 676 342) (“Kate Morgan”). Kate Morgan endeavours to make your experience while dealing with our weight-loss consultants in the pharmacies, or when using our website and ordering Kate Morgan products online, as enjoyable and simple as possible. However, we recognise that for you to feel comfortable when talking to our consultants, accessing our website and ordering products online, your privacy and the security of your personal information needs to be maintained. Kate Morgan is aware of the requirements of the Privacy Act 1998 (Clth.), and has developed practices and procedures regarding the collection, storage and use of your personal information intended to comply with the ten National Privacy Principles prescribed by that act. (A copy of these principals is available at www.privacy.gov.au).
This Privacy Policy sets out the procedures adopted by Kate Morgan when handling your personal information and protecting your privacy. It is also intended to advise you of our obligations and your rights relating to your personal information.
The terms of this Privacy Policy are intended to form part of the terms and conditions of use of this website and any membership agreement between you and Kate Morgan. We may amend this Privacy Policy from time to time and will post any changes here. Please refer back to this Privacy policy on a regular basis.
How information is collected?
Kate Morgan collects personal information in two ways: -
- Directly through personal consultations with our weight-loss consultants in pharmacies,
- Through other correspondence such as application forms, emails, telephone conversations, feedback provided in our members forum.
In the event of a complaint we may also receive personal information about you from other parties who may tell Kate Morgan about any complaint. Kate Morgan may also collect personal information from other sources that are publicly available such as websites, journals and phone books.
What information is collected?
Kate Morgan only holds your personal information if it is relevant to providing you with services and products. The type of information held includes your name, address, contact details (including your postal and email addresses), phone numbers, payments details, account number, and records of correspondence and billing.
Kate Morgan may also hold sensitive personal information about you, including family medical history, dietary requirements, previous or current illnesses and injuries, and information about your current state of health including your height, weight and age. However, such personal information will only be held by Kate Morgan if it has been collected with your consent.
Information and children
The Kate Morgan Weight Loss Program has not been specifically designed for people under 18 years of age. We are aware however that there may be children that may benefit by taking part in the Kate Morgan Weight Loss Program. However before people under the age of 18 commence the program we require that they seek medical advice and receive approval from their health care professional. To ensure the privacy of children and the security of personal information about children Kate Morgan will not knowingly collect, use or disclose information about a child without obtaining the prior written consent of a parent or guardian.
Cookies
A Cookie is a small file containing data that is stored on the user’s computer hard drive. The cookie stores a small amount of information about the user and makes our website easier to use. Cookies allow our server to keep a record of some details of clients that visit our website and store some of the data provided during online registration. Cookies are “non-executable” files that are incapable of doing anything to your hard drive.
Web browsers can be set to reject cookies. If you choose to set up your browser to reject cookies you can still use our website but may not be able to take advantage of certain features. How is the personal information held?
Kate Morgan may hold your personal information in either hard copy or electronic form. A copy of all written correspondence (including application forms completed when you become a member) is held in hard copy. Kate Morgan’s client database and email correspondence are held in electronic format.
How does Kate Morgan use Personal information?
Kate Morgan uses your personal information to provide you with products and services, and to provide you with support while you are on the Kate Morgan Weight Loss Program.
We may need to disclose some of your personal information, such as your address, to a delivery service so that we can arrange for the products you order to be delivered. We may also ask you for your consent to provide your personal information for the purpose of providing you with marketing information that may be of interest to you. If you consent and provide such information we will only use the information for that purpose or a related secondary purpose.
Kate Morgan also retains your order details in a secure offline database. This is so that we have a record of your order should you subsequently have any queries relating to the delivery of your order.
How does Kate Morgan disclose your personal information?
Kate Morgan will only disclose your personal information for a purpose related to providing you with products and services related to the Kate Morgan Weight Loss Program. Kate Morgan will not disclose personal information about you without your consent, or access correspondence on the website unless it is considered necessary to: -

- protect the rights and/or property of Kate Morgan, Kate Morgan clients or any other person, or
- minimise or prevent any threat to the health safety or well-being or any person.
Kate Morgan may share aggregated demographic information obtained from this website with our business partners and advertisers. This information will not contain details that could be used to identify any individual.
Independent contractors
From time to time Kate Morgan may engage independent contractors to provide specific services related to the provision of products and services related to the Kate Morgan Weight Loss Program. These services may relate to the ongoing development of this website and email services, providing credit card processing and fraud screening. These independent contractors may be provided with limited access to information on this website, including access to your personal information where such access is reasonably necessary for them to perform their role. Where such access is granted, Kate Morgan requires the independent contractors to comply with the standards set out in the Privacy Act 1988 (Clth) consistent with this Privacy Policy, and not use or disclose any personal information for any purpose other than to provide the service for which they are contracted.
Sale of business
Kate Morgan reserves the right to transfer information, including your personal information, to a third party in the event of a sale, merger or other transfer of all or of substantially all of the assets of Kate Morgan Pty. Ltd. or of any companies affiliated with Kate Morgan Pty. Ltd. provided that the third party agrees to adhere to the terms of this Privacy Policy.
How secure is the personal information held by Kate Morgan?
Kate Morgan holds all personal information, including information held as a hard copy or as an electronic record, in a secure manner. Kate Morgan adopts strict procedures to ensure that the information is protected from misuse, unauthorised access, modification and disclosure. Only staff who require access to your personal information have access to the relevant records, and they are deleted once they are no longer needed or required to be kept by law. Once the information is no longer required hard copy records are shredded and electronic records are demagnetised.
Kate Morgan endeavours to provide a secure environment for transmission of information from your computer to our server, and strives to adopt practices that are industry best practices. Kate Morgan uses firewalls and Secure Socket Layer (“SSL”) encryption technology to ensure the integrity and privacy of any personal information held. Unencrypted credit card details are not stored on our server, and only encrypted information relating to your credit card details are transmitted when you use our website. In addition, Kate Morgan’s order processing system is protected by a firewall, which restricts access to authorised users.
When online your personal information is only accessible to someone who can supply your username and password. Consequently it is important to be aware of the need to be cautious about the security of your username and password.
It is also important to be aware that once you disclose any personal information online (e.g. by posting information in a discussion forum) it can be collected and used by others without your consent or knowledge. When making your request please let the Privacy Officer know whether you wish to inspect the company records in person at your pharmacy or other Kate Morgan premises, or whether you would prefer to be sent a photocopy of electronic record of the information held at Kate Morgan. You do not need to give a reason for your request.
Once the Privacy Officer has verified your identity, your request will be acknowledged within 14 days and arrangements will be made to provide you with access to the information in an appropriate manner in a reasonable time. Kate Morgan may charge you a reasonable fee for providing access to the information and presenting it in a reasonable form. If a fee is required the Privacy Officer will notify you the basis for charging the fee.
In exceptional or rare circumstances Kate Morgan may not be able to provide you with access to the personal information. These circumstances are set out in the Privacy Act 1988 (Clth) and may include the following circumstances: -
- Where granting access to the information may have an impact on the privacy of other people;
- Where granting access poses a serious threat to the health or well being of another person;
- Where the request is frivolous or vexatious
- Where the information sought relates to existing or anticipated legal proceedings and the information would not be discoverable in those proceedings.
If Kate Morgan is unable to provide you with access to the information requested the Privacy Officer will advise you why the requested access can not be granted and if appropriate for an intermediary to be appointed to act as a facilitator to provide you with sufficient access to the information requested.
Correcting or changing your personal information
In the event that the personal information held by Kate Morgan is incorrect or out of date please inform the Privacy Officer of the need to change the information and Kate Morgan will correct the information for you. The Privacy
Officer can be contacted in any of the ways set out above under the heading “Access to your personal information”.
In the unlikely event that Kate Morgan does not agree with the need to change your personal information you may provide a written statement indicating that you dispute the accuracy of the information held by Kate Morgan. This written statement will be associated with the relevant personal information so that it will be bought to the attention of any person who uses or has access to that personal information.
Promotional and marketing information
To assist and support you while using the Kate Morgan Weight Loss Program we would like to send you newsletters and other information about products and services that may help you reach your goal weight. However, Kate Morgan understands that you may not wish to receive any marketing material. If you would prefer not to receive any of this information please contact our Privacy Officer and Kate Morgan will ensure that your details are removed from our mailing list. The Privacy Officer can be contacted in any of the ways set out above under the heading “Access to your personal information”.
Transfer of your personal information overseas
Kate Morgan will only transfer you personal Information overseas if the transfer is to you, or one of your authorised representatives, or the transfer is with your consent or necessary for the supply of products and services to you. Kate Morgan will not send your personal information outside of Australia in any other circumstances, and if personal information is sent overseas Kate Morgan will endeavour to ensure that such information is protected by principles consistent with this Privacy Policy.
Complaints about the handling of personal information
Kate Morgan is committed to upholding the ten National Privacy Principles set out in the Privacy Act 1988 (Clth.) and strives to maintain privacy and security your personal information. If you are not satisfied with the way Kate Morgan has handled your personal information, you are entitled to lodge a complaint with the Federal Privacy Commissioner. Information about how you can lodge a complaint can be found on the Privacy Commissioner’s website (www.privacy.gov.au) or by calling the Privacy Commissioner’s information line on 1300 363 992.
It is important to note that before the Privacy Commissioner will handle any complainant the Commissioner is required to be satisfied that you have first raised any complaint with Kate Morgan and attempted to resolve the complainant in accordance with this Privacy Policy. Kate Morgan will make every effort to resolve your complaint. Please lodge any complainant with the Privacy Officer.
